LiliApp develops technologies and services that allow people to connect with each other, register and share their wishes, receive recommendations from third parties – individuals or companies, and benefit from the service of a personal shopper. These conditions govern the use of LiliApp, and the products, functionalities, applications, services, technologies and software that we offer, except when we expressly indicate that conditions other than these apply.

1.     Definitions

Client, User or Registered User: any person registered on the website TheLiliApp.com

Wish list: space created and managed by the User through which they share the information related to their wishes

Authorized: User who has been authorized to access the private wish lists of other users

Administrator: User who creates a group with other LiliApp users

Group: space where you can share all the information they consider useful associated with an event

Guest: User member of a Group

Personalized services: Services provided by LiliApp that allow users with a smartphone, tablet or personal computer to make use of and pay for the personalized gift and personal shopper services provided through the web.

 

2. Purpose

Social Network through which Users can store their wishes, share them with their contacts, and receive recommendations to guide their purchase of any type of products or services. Purchases of products or services will be made at third-party points of sale. The social network will have spaces as a service for third-party advertising. Additionally, through the social network you can manage the group purchase process, and benefit from the personal shopper service to purchase the gift.

In the statuses, the main source of income is advertising revenue, IAE E769.9 – Other private telecommunication services n.e.c.

We do not charge you for the use of LiliApp. Instead, companies and organizations pay us to show you advertising about their products or services. By using our products, you agree to show us advertisements that we consider relevant to you and your interests. To determine these ads, we use your personal data.

We do not sell your personal data to advertisers or share any identifying information (such as your name, email address, or other contact information) with them, unless you give us specific permission. Instead, advertisers provide us with information, such as the type of audience they want to reach with their ads, and we show them to people who may be interested in them. In addition, we provide advertisers with reports on their advertising performance so they know how people interact with their content.

Our Data Policy details how we collect and use your personal data to determine some of the ads you see and offer the rest of LiliApp’s services. In the configuration of your wish lists, you can also review the privacy options (Who can see my wishes?) That you have available to determine the use we make of your data.

 

3. Registration

Signing up is vital to take advantage of the services offered by creating wish lists, groups, and virtual wallet. The User will be asked to provide a certain amount of personal information. All the information provided by the User through these certified procedures to obtain the services provided by LiliApp must be truthful and exact, and for this reason, guarantee the authenticity of the User. If the User refuses to provide the aforementioned information, then she will be prevented from creating her personal space and, consequently, her subscription to the services mentioned below will also be canceled.

When creating a personal space with LiliApp, you must create a profile with an email and a password that the User agrees to use. This password establishes a guarantee of confidentiality of the information contained in the personal space and, therefore, the User is prohibited from sharing this information with a third party. Consequently, the User is the only person responsible for their password and LiliApp will not be responsible for unauthorized access to the User’s account.

4. Overview of LiliApp services

4.1. Wish Lists

LiliApp allows creating wish lists in the personal space of the registered user “My Lists”. Users can create their own gift ideas and add them to their lists. The User must add the name of the wish, additionally they can add a photo, description, price, store, reference website, notes. LiliApp will not be responsible for any intellectual property rights that may derive from the aforementioned descriptions and / or photos of the gift ideas added by the Users, as well as their existence.

Every time you create a wish list you can choose who will see it, and you will be able to access its content. The Authorized to each of your wish lists may copy wishes from your lists.

You can also create public lists that can be accessed by all registered LiliApp Users.

The authorized management of each wish list you have created can be updated at any time.

By default, we provide you with two public “My Wishes” wish list, which can be viewed and accessed by all LiliApp users; and “Recommendations”, in which you can receive recommendations from third parties.

4.2. Groups

LiliApp offers Users a platform where they can create Groups to share all the information they consider useful associated with an event. The Group administrator manages access to the group through invitations. Only LiliApp users can access the Group information. The latter have a chat through which information can be communicated and shared. The Guests of the group can benefit from different services, such as the purchase of personalized gifts for the event, and a personal shopper service. In case of benefiting from any of these services, the guests pay for the services, with the Administrator being responsible for purchasing the gift. The Group’s closing date is defined by its Administrator.

4.3. Customized services

In the case of users, who wish to access personalized services through the web www.theliliapp.com

  • Personal information. At the time of registration, they will have to provide all the personal data that is compulsory requested (other data may be requested to be provided voluntarily). The User will be responsible at all times for the veracity and updating of the data, personal or of any type, that he contributes to the registration in the personalized services or for the use of these. The mere suspicion of the lack of veracity or updating of such data will enable LiliApp to block the user and, if it so decides at its own discretion, resolve the relationship between the parties, without the right to compensation or compensation in favor of the User.
  • Payment method and charge authorization. If you are under eighteen (18) years old, you can only use paid functions through the LiliApp Services with the participation of your father, mother or guardian. To be able to use the personalized services offered by LiliApp, the User must have chosen a form of payment (for example, debit / credit card) associated with their User, in the registration process, and have entered the corresponding data, to allow the loading of the deposit or virtual account that the user maintains with LiliApp, for the amount that he decides at all times. The owner or at least one co-owner of the means of payment must coincide with the User. The User authorizes LiliApp to charge in the designated payment method the amounts derived from the use of the Service and in general from the application of these Conditions (rates, fees, prices, damages, management expenses, etc.). Once the debit / credit card has been established as a means of payment, it may be modified by another with the same previous requirements, but not eliminated, since it is constituted as a means of guarantee of payment against service payments that may arrive deferred. In the event that the User so establishes it in the configuration options, and, in any case, when a Service has been contracted and there has not been enough balance in the wallet, automatic recharges may be made for the amounts established by the User or determined in the specific conditions of the Service.

 

5. Paymnet methods

All payments on LiliApp are made through (1) Redsys, Spain’s leading payment platform, which has been successfully solving over 90% of all payment methods activity for more than 35 years. LiliApp accepts the following credit and debit cards as payment methods: Visa, MasterCard, American Express and DinersClub.

 

6. Cancellation / return policy

Most of the products bought in LiliApp can be returned, as long as they keep the original packaging and are in perfect condition. Including accessories, documentation and original packaging, otherwise the asset will suffer a depreciation. There are some exceptions and certain deadlines to be able to make the return.

Please note at the time of the return that you do not include any product outside the LiliApp website. Please note that we will not be responsible for it and neither the product nor the corresponding amount will be returned.

In accordance with the exceptions to the Right of Withdrawal regulated in RDL 1/2007, the return of those products configured to measure (personalized) will not be accepted.

You will only be responsible for the decrease in value of the goods resulting from manipulation other than that necessary to establish the nature, characteristics and operation of the goods.

This will also apply to items such as mobile phones, tablets, computers, etc …, devices in which you have registered, activated security features, geolocation or patterns, since the initialization of these devices requires the prior and voluntary registration of your personal data, which is stored in the memory of the terminal.

Once the merchandise has been received in our warehouses, and after checking its condition, the amount will be reimbursed, in accordance with the method of payment made by the client, in any case, within a period not exceeding 14 calendar days. from the receipt of the returned merchandise. The direct cost of returning the good or service will be assumed by the customer as stated in the LGCU.

How do I return a product?

The first thing you should do is send us an email to: devoluciones@theliliapp.com Please ask us to identify your purchase, and the reason for the disagreement. You have 14 days to start the procedures.

We will send you a response email confirming the return, assigning you a reference number so that you always have it located and clearly indicating the steps to follow to send the product to us.

As soon as we receive it and check the good condition of the garment, we will start and if we have made a mistake in the order or it is defective, first of all we apologize. We will take care of all the costs of collection and shipping, we will prepare the order again and we will send it back to your home as quickly as possible so that you can enjoy it.

If the return is for a reason beyond our control, we can return it without problem (except products that cannot be returned – see What products can be returned?). In this case we are very sorry but the collection and shipping costs will be borne by you.

What products cannot be returned?

Almost all products can be returned or exchanged while they are unused and in perfect condition, including accessories, documentation and original packaging. Although there are exceptions to the right of withdrawal. The return will not be applicable to:

  • The provision of services, once the service has been fully executed, when the execution has begun, with the prior express consent of the consumer and user and with the acknowledgment on their part that they are aware that, once the contract has fully executed by the employer, you will have lost your right of withdrawal.
  • The supply of goods or the provision of services whose price depends on fluctuations in the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.
  • The supply of goods made according to the specifications of the consumer and user or clearly personalized (for example: weapons, furniture, custom clothing, custom clothing such as sports shirts with personal names).
  • The supply of goods that can deteriorate or expire quickly (for example: food, flowers, fruit baskets …).
  • The supply of sealed goods that are not fit to be returned for reasons of health protection or hygiene and that have been unsealed after delivery (for example: earrings, all beauty articles, toiletries, cosmetics, toilet personal, hair accessories, underwear, stockings and pantyhose, and all those products for body use).
  • The supply of goods that, after delivery and taking into account their nature, have been inextricably mixed with other goods.
  • The supply of alcoholic beverages whose price has been agreed at the time of the sale contract and which cannot be delivered before 30 days, and whose real value depends on market fluctuations that the entrepreneur cannot control.
  • Contracts in which the consumer and user have specifically requested the employer to visit him to carry out repair or urgent maintenance operations; If, on that visit, the entrepreneur provides additional services to those specifically requested by the consumer or supplies goods other than the spare parts necessarily used to carry out maintenance or repair operations, the right of withdrawal must apply to such additional services or goods. .
  • The supply of sound recordings, videos, video games and sealed computer programs provided on any physical medium (CD, Vinyl, DVD, Blu-ray, etc.), which have been unsealed by the consumer and user after delivery.
  • The provision of digital content that is not provided on a material medium.

 

7. Shipping policy

Shipping costs may vary depending on the product, the final amount of the order, the number of units, the volume, the weight and the type of shipping.

In general, shipping to all of Spain will cost you 5 Euros. If your shipment is to Europe the cost is € 15 and to the rest of the world € 24. We are trying to adjust these prices shortly we will succeed!

All transport and shipping costs INCLUDE VAT.

We know that you are eager to receive your purchase so we will rush to prepare it and send it wherever you want.

The general delivery time in the peninsula, the Balearic Islands and the European Union is 10 working days. The delivery time in Tenerife and Gran Canaria is 10-15 working days. In Lanzarote, Fuerteventura, La Palma, Hierro and Gomera it is 16-21 business days. The term in Ceuta and Melilla is 21 working days, although the term may vary depending on the type of product. Saturdays, Sundays and holidays are excluded in all these periods.

Remember that each Customs has a collection period for the merchandise after which it is abandoned, the client being responsible for any future consequences.

And the general delivery time to international destinations that are not in the European Union is approximately 10 working days at customs. The delivery time at home will depend on the time it takes to pay the taxes (except customs inspections).

These terms may vary depending on the product. LiliApp will not be responsible for delays that occur due to causes beyond its control or force majeure.

 

8. Modifications and cancellations of services

The characteristics of the Services may be modified by LiliApp in order to adapt them to technical developments, as well as any technical improvement or not, which in LiliApp’s sole judgment allows incorporating a greater number of features into the Services.

Likewise, the CLIENT may modify the conditions of the contracted Service at any time or unsubscribe from the service, and with the limitations established in these terms and conditions or those specifically applicable to the different Services, through the CLIENT’s own user panel, since The service does not imply any permanence or minimum contract time, always taking into account that a period invoiced and paid cannot be paid unless the withdrawal is caused by technical problems responsible for LiliApp.

The cancellation or modification policy applicable to each reserved product is specified in the legal conditions.
